Portland, Oregon — An Oregon father has been sentenced to 10 years in prison after accepting a plea deal in the death of his 4-year-old son, a case that began as a short visit and ended in tragedy.

Marquavious Ware, now 23, pleaded guilty to second-degree manslaughter in the May 2023 death of Jhorden Clay. Original charges of murder and assault were reduced under the plea agreement. Ware received credit for time served since his arrest.

Court records state that a family member heard Ware yelling and later found Jhorden in the bathtub while Ware was washing blood from the child’s mouth. Police reported blood in the bedroom and bathroom, along with other signs of violence. Medical examiners documented extensive bruising across Jhorden’s body, cigarette burns, and scars. Another child in the home told investigators that Ware had kicked and stomped the boy.

Jhorden’s mother has said she repeatedly warned authorities about suspected abuse, providing FaceTime screenshots and photos. She also sought a restraining order, which was denied. The boy’s estate has filed a $17 million lawsuit against the Oregon Department of Human Services and the city of Portland, alleging officials failed to adequately investigate prior reports. An internal DHS review later concluded that the reports should have been examined more thoroughly.

The case has drawn widespread attention to child protection failures and the devastating consequences of unchecked abuse.
