The legal situation surrounding Kim Zolciak’s teenage son has become significantly more serious since his initial arrest in August.

Kroy “KJ” Biermann Jr., 15, was initially arrested in Alpharetta, Georgia, on allegations stemming from an incident reported to have occurred on April 23, 2026.

He was originally charged with aggravated sexual battery and aggravated sodomy.

But the case has since expanded.

In September, a Fulton County grand jury indicted KJ on seven felony counts, including aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under 16.

KJ has denied the allegations through his attorney, while his mother has publicly defended him and urged people not to treat unproven accusations as established facts.

The case first became public after KJ was arrested on August 17 in Alpharetta.

Because of the nature of the initial charges, prosecutors are treating him as an adult under Georgia’s SB440 law, which allows certain teenagers between 13 and 17 to face adult-court jurisdiction for specified serious offenses.

At the time, KJ was being held at the Metro Regional Youth Detention Center.

The original case involved an alleged encounter at a Lifetime Fitness facility on April 23.

According to reporting based on police records, a teenage girl reported the allegations and was taken to a hospital for an examination.

The police report cited by Us Weekly stated that testing did not find male DNA in the areas examined. That information has been emphasized by KJ’s defense, but it does not by itself determine whether the allegations are true or false.

GRAND JURY ADDS FIVE MORE FELONY COUNTS

A Fulton County grand jury returned a seven-count indictment against KJ.

According to the indictment, the charges relate to an alleged incident on April 23, 2026.

KIM ZOLCIAK CONTINUES TO DEFEND HER SON

He must also wear electronic monitoring.

The court prohibited him from using a cellphone or social media.

Most significantly, he is prohibited from having direct or indirect contact with the alleged victim, her family or associates.

The judge also prohibited KJ from having contact with anyone age 16 or younger.

The restrictions mean that even if KJ is released from detention, his daily life will remain heavily controlled while the case proceeds.

ANOTHER CASE EMERGES DURING THE BOND HEARING
The September bond hearing also revealed another legal matter involving KJ.

Prosecutors reportedly told the court about a previous juvenile sexual-battery case involving an underage relative.

According to reporting on the hearing, investigators allegedly discovered recordings involving KJ and a family member younger than 12.

KJ’s attorney strongly disputed the characterization of that earlier matter, saying the circumstances had been misrepresented and describing it as inappropriate behavior involving two middle-school-aged children.
