SUFFOLK COUNTY, N.Y. — In an emotional courtroom statement, Nassau County Police Officer Francisco Malaga fought back tears as he described responding to a fatal drunken driving crash on January 31 — only to realize his own wife, fellow officer Patricia Espinosa, 42, was the victim. Malaga spoke at the sentencing of 21-year-old Matthew Smith, who pleaded guilty to aggravated vehicular homicide and related charges.

Espinosa was off-duty and driving when Smith, who was heavily intoxicated and speeding, allegedly ran a red light and slammed into her vehicle. She died from her injuries. Smith was sentenced to 7⅓ to 22 years in prison under a plea agreement.

“I watched the love of my life slip away — and that image will stay with me the rest of my life,” Malaga said, recounting the devastating discovery at the scene while on patrol. The couple had served together on the force, and the tragedy has left their family shattered.

Smith, of Hauppauge, faced multiple charges including aggravated vehicular homicide while intoxicated. Prosecutors noted his high level of impairment and reckless driving led to the fatal collision. He had previously been indicted and changed his plea to guilty in June.

The case has drawn attention to the dangers of drunk driving and its profound impact on law enforcement families. Espinosa was remembered as a dedicated officer, while Malaga’s testimony highlighted the personal toll of such tragedies.
